Chapter 1 General Provisions
Article 1: To improve the labor contract system, Party A employs Party B as a laborer. To safeguard the legitimate rights and interests of both parties in their labor relationship, in accordance with national labor laws, regulations, and policies, and to build a harmonious and stable labor relationship, the parties have agreed to enter into this contract upon mutual consultation.
Chapter 2: Labor Contract Establishment
Article 2: Party A assigns Party B to the position of Production Line Worker.
Article 3: The contract term shall commence on _____ year _____ month _____ day and terminate on _____ year _____ month _____ day; renewal is available upon expiration.
Article 4: Party A is obligated to conduct ideological and political education for Party B and require the employer to provide necessary labor supplies in accordance with national regulations, as well as to educate on safety production and operation knowledge to ensure the safety and health of Party B.
Article 5: The Party B must comply with the allocation of Party A and the employer, and complete the production (work) tasks prescribed by the manufacturer on time; Party B must strictly adhere to all regulations and production operation procedures of Party A and the employer to ensure safe production.
Chapter 3: Compensation for Labor
Article 6: During the tenure of employment, Party A shall provide food and accommodation for Party B. Party A guarantees Party B's salary benefits, and requires that Party B's identity is authentic and all necessary documents are in order.
Article 7: Party A shall be responsible for handling the relevant social insurance matters for Party B, and Party B is required to provide the necessary documents.
Article 8: The salary of Party B is paid on a time-based system, with the monthly salary calculated based on total working hours, with a rate of ___ yuan per hour, without distinction of time periods; if Party B's monthly salary does not reach 1000 yuan, the company will make up the difference (except for those who violate the factory rules and regulations, are absent without leave, take leave, arrive late, leave early, or are fined, as the company will not make up the difference); after working for three months, the rate will be ___ yuan per hour.
Article 9: Salaries for the previous month will be distributed on the _____th of each month under the supervision of the factory and the company. (In case of holidays, the distribution will be arranged around the working days when the holidays are observed.)
Article 10: During the contract period, any expenses related to injury, disability, or death caused by the Party B's work shall be handled by the actual employer in accordance with the current national regulations. Expenses related to accidents caused by the Party B themselves shall be borne by the Party B. The Party A shall assist the Party B's actual employer in handling such matters. In this case, if the Party B has already received various compensation or indemnification benefits within the scope of the national legal and policy provisions, the Party B shall not claim any liability or rights from the Party A or the employer.
Article 11: Party B will be reimbursed for the round-trip transportation expenses to return home upon completing one year of work at the factory.
Chapter 4: Execution and Modification of Employment Contracts
Article 12: In the following circumstances, Party A may terminate the contract or have the employer terminate the labor contract, and Party B shall bear any resulting losses independently:
1. Demonstrated to be unsuitable for the position during the trial period.
2. Severe violation of the labor discipline and regulations of Party A or the actual employer, and persists despite education.
3. Gross dereliction of duty, abuse of power for personal gain, resulting in significant losses to Party A and the employer.
4. Subject to criminal prosecution or administrative penalties.
5. The Counterparty concurrently establishes labor relations with other employers and, after being pointed out by Party A and the employer, still refuses to make corrections.
6. Unable to perform the original job or any alternative job arranged by Party A after the expiration of the specified period due to illness or injury not work-related.
7. The Party B is unable to perform the job at the actual employer's place of work, even after training or a job position adjustment, or if returned by the actual employer.
8. Where the Counterparty significantly breaches the contract in other respects.
9. The Party B resigns from the actual employer without written consent from Party A.
Article 13: In any of the following circumstances, Party B may terminate the contract:
1. The employer's labor safety and hygiene conditions are confirmed to be severely poor by the labor safety supervision authority, posing a significant threat to the physical health of workers.
2. Party A fails to fulfill the labor contract, or violates national laws, policies, or infringes upon Party B's legitimate rights and interests.
3. Party B is unable to fulfill the labor contract due to physical changes or other special circumstances.
4. Party A fails to pay labor remuneration as agreed or provide labor conditions.
5. The actual employer's rules and regulations violate laws and regulations, harming the rights and interests of laborers.
Chapter 5 Termination and Cancellation of the Contract
Article 14: The employee must work for a full 3 months before resigning. They must apply for leave with the factory management 7 days in advance and obtain company approval before resigning. Wages must be settled within 3 working days of resignation; employees who resign before completing one month are not entitled to wages.
Article 15: If the party B has worked for 1 month but less than 3 months, or is dismissed by the factory, the company will deduct 30% of the salary as a contract penalty for breach of contract.
Article 16: In case of serious violations by employees (theft, fighting, severe damage to production, strikes, or disturbances), the company may terminate the employment without pay for those with severe circumstances. A fine of 100 yuan will be imposed for a day of absence without leave; for three consecutive days of absence without leave, it will be considered as an automatic resignation, without pay settlement, and termination of the contract.
Article 17: Matters not covered by this contract shall be executed in accordance with relevant laws and regulations. In case of disputes, they shall be resolved through negotiation. If negotiation fails, either party may file a lawsuit in the court located in the place of the counterparty.
Article 18: This contract shall become effective upon the signatures of both Party A and Party B.
