If you have an objection to being listed on the abnormal business operation list, you may submit a written application to the administrative department of industry and commerce that made the decision, along with relevant materials, within 30 days of the public announcement. The industrial and commercial department will review the application to determine if it will be accepted within 5 working days. This situation is very rare; generally, businesses listed as abnormal have undergone a review by the industrial and commercial bureau, so applications are usually rejected, but it is not excluded that they may not be.
How to remove abnormal operation?
1. If the annual report has not been submitted or submitted late, the first step is to make up for the unsubmitted annual reports, and then submit an application for abnormality removal to the local Administration for Market Regulation. The administrative department will handle the application within 5 working days upon receiving it, and after the fine is paid, the abnormality will be removed.
2. Address verification failed: First, a change of registered address is required, followed by submitting an application for removal at the local Industrial and Commercial Administration Bureau. The administration will conduct an on-site investigation within 5-10 working days upon receiving the application. If no actual location is found, the application will be rejected. If an actual location is confirmed, the address anomaly will be immediately lifted.
3. Fraudulent Public Information: First, correct the false information, then submit an application to the Industrial and Commercial Administration Bureau. After the Bureau verifies the information is accurate, the anomaly will be removed; otherwise, the application will not be accepted.
Due to failure to comply with Article 8 of the Interim Regulations on Publicity of Enterprise Information by submitting the annual report for the previous year through the Enterprise Information System and making it publicly available, the enterprise may apply to be removed from the list of abnormal business operations after submitting the annual reports for the missed years and making them public. The administrative department of industry and commerce shall make a decision to remove the enterprise from the list within 5 working days upon receiving the application.
Entities listed in the business abnormality records may apply to the administrative office that made the listing decision to be removed from the records within 3 years of the listing, provided they have legally fulfilled the obligation of public disclosure. Specific conditions:
1. Please submit the补充 reports promptly. The annual report feature in the public announcement system has been reopened. Those who haven't filed their annual reports yet, please hurry and do so. Don't forget to fill in the public announcement section accurately as well.
2. Within three years from the date of being listed on the abnormal records.
3. Apply to the Administration for Market Regulation. After the补充报告，you will need to bring a copy of the business license (with the official seal), a power of attorney and a copy of the authorized person (with the official seal), and an application for removal from the abnormal list to the business license registration department of the company. The application should clearly state the reasons for the late annual report, the time of the supplementary report, the content of the application, and the signature with the official seal.
