Under Article 47 of China's Environmental Protection Law, enterprises and institutions shall formulate emergency response plans for sudden environmental incidents in accordance with the relevant regulations and file them with the environmental protection authorities and relevant departments for record. In the event of, or in the likelihood of, a sudden environmental incident, enterprises and institutions shall take immediate measures to address the situation.
Promptly notify units and residents that may be affected and report to the environmental protection authorities and relevant departments.
The "Emergency Response Plan for Unexpected Environmental Incidents in Enterprises and Institutions (Trial)" (Circulation No. 4 [2015]) states that enterprises shall adopt emergency measures to avoid or minimize the entry of pollutants or other toxic and harmful substances into the atmosphere and water bodies outside the factory boundaries when responding to various accidents and natural disasters.
The company has pre-planned work plans for soil and other environmental media.
The "Emergency Management Measures for Unexpected Environmental Incidents" (implemented on June 5, 2015) Article 6 of the former Ministry of Environmental Protection stipulates that enterprises and institutions shall fulfill the following obligations in accordance with the requirements of relevant laws, regulations, and standards:
Conduct risk assessment for sudden environmental incidents.
Enhanced risk prevention and control measures for sudden environmental incidents.
Identify and address environmental safety hazards.
Establish and file emergency response plans for environmental incidents, along with drills.
Enhance environmental emergency response capability and infrastructure construction.
In the event of, or in the likelihood of, an unexpected environmental incident, enterprises and institutions should handle the situation in accordance with the law and be responsible for any damages incurred.
