Important Considerations for Individuals Filing Trademark Registration Applications
Pursuant to Article 4 of the Trademark Law of the People's Republic of China, individuals engaged in the production, manufacturing, processing, selection, distribution of goods, or provision of services must apply for trademark registration with the Trademark Office to obtain exclusive trademark rights. When handling trademark registration and transfer applications in their own name, in addition to submitting the "Trademark Registration Application Form" and trademark designs as required by relevant regulations, attention should also be paid to the following matters:
Individual business owners may submit a trademark registration application using the name on their "Individual Business License" as the applicant's name, or they may use the name of the registered person on the license. When applying in the name of the registered person, a copy of the following documents should be submitted:
Identification card of the responsible person.
Certificate of Business Registration.
Individual partners may file a trademark registration application in their own name using the name on their Business License or the name registered with the relevant administrative authority. Alternatively, they may file a joint application in the name of all partners. When filing a joint application in the name of all partners, the following documents should be submitted as copies:
Partner's ID card.
(2) Business License
(3) Partnership Agreement.
Farmers' households engaged in contracted management may file a trademark registration application in the name of the signatory of their contract. Upon application, they should submit copies of the following materials:
(One) Identity card of the signatory.
Contract for Commission
Section 4: Individuals legally permitted to engage in business activities may file a trademark registration application using the name of the operator as recorded in the registration documents issued by the relevant administrative authorities. Upon application, they must submit copies of the following materials:
Operator's ID card.
(II) Regarding the registration documents issued by the administrative authority.
Natural persons filing for trademark registration applications should limit the scope of goods and services to those approved in their business license or relevant registration documents, or to the agricultural and sideline products they self-operate.
For trademark registration applications that do not comply with Article 4 of the Trademark Law, the Trademark Office will not accept them and will notify the applicant in writing.
If an applicant obtains trademark registration by providing false materials, the Trademark Office shall revoke the registration of such trademark.
Section 7: In processing a trademark transfer application, where the transferee is an individual, refer to the aforementioned matters for handling.
